Erica Herman Takes Tiger Woods to Court with Speak Out Act
Tiger Woods’ former girlfriend Erica Herman is taking the golf legend to court in an attempt to nullify a non-disclosure agreement (NDA) that she claims she was forced to sign at the start of their relationship.[0] Herman cited the Speak Out Act, which prohibits the judicial enforceability of a nondisclosure clause or nondisparagement clause agreed to before a dispute arises involving sexual assault or sexual harassment in violation of federal, tribal, or state law.[1]
Herman, who was the general manager at Woods’ restaurant The Woods Jupiter and started dating Woods in 2017, is now asking a judge to declare the NDA invalid.[2] According to paperwork obtained by TMZ, Herman said a private trust run by Woods is attempting to keep her quiet about their relationship by “aggressively” enforcing the NDA.[3]
The Speak Out Act was signed into law in December 2022 as part of a wave of legislation spurring from the #MeToo movement.[4] The law cites NDAs were found to perpetuate illegal conduct.[4]
It is unclear when Woods and Herman split as they have not been seen together in public since the U.S. Open in August 2022.[5] They were first pictured together at the Presidents Cup in September 2017, where Herman wore a badge reserved for the girlfriends and wives of players.[6] Herman was also by Woods’ side as he won the 2019 Masters and his historic 80th PGA Tour win at East Lake, Georgia.[7]
